These General Terms and Conditions govern the use of the BaitsInfinity web store at https://www.baitsinfinity.com. The site www.baitsinfinity.com is owned by Hostonski d.o.o. Users are advised to read these terms and conditions carefully before use. Your agreement to the terms and conditions listed here is a good prerequisite for making a quality purchase. You accept these General Terms and Conditions electronically when confirming an order in the web store. According to the Consumer Protection Act, minors or completely incapacitated persons cannot make a distance purchase. Only their legal representatives can do that. The general terms and conditions of the BAITSINFINITY web store have been compiled in accordance with the Consumer Protection Act, the Personal Data Protection Act and the Electronic Commerce Act in force in the territory of the Republic of Croatia. In the General Terms and Conditions, the terms written in bold will have the meaning given below:
- User means any person, legal or natural, who accesses the Website. The term user also includes a registered user.
- Registered user means any fully capable person, legal or natural, who has registered to use the Web Store service on the Website.
- BAITSINFINITY means Hostonski d.o.o., with its registered office in Vinkovci, Bana Jelačića 54, entered in the court register of the Commercial Court in Osijek under the registration number of the subject of registration MBS: 030074947, OIB: 52482534377 (hereinafter: the “Seller”).

The Seller reserves the right to change or cancel these General Terms and Conditions without prior notice. Users are obliged to check the valid General Terms and Conditions every time they use the website. The applicable general terms and conditions will be published on the website. In case of disputes, the version that was valid at the time of the purchase and with which you as a user have expressed your consent at the time of placing the order will apply. We hereby inform you that there is a possibility of periodic changes to the General Terms and Conditions of Use of the web store in order to comply with changes in the law or our business needs. We are technically unable to notify each user of any changes, so we recommend that you read this text when reusing the web store to be aware of possible changes.
USER REGISTRATION
The user is registered through the website, during which the user will be obliged to enter certain personal data and agree to the use of such personal data.

The Registered User agrees that the purchase through the Web Store is made by the Registered User purchasing products and services available through the Web Store (“Products”) by selecting them based on the image and basic product description. Product ordering is done electronically. By clicking on the “add to cart” icon, the selected product is saved in the consumer cart. To continue the procedure, it is necessary to click on the “contents of the basket” where all the selected items are located. Goods are considered ordered at the moment when the customer goes through the entire ordering process. CONCLUSION OF A SALES AGREEMENT
These conditions as well as individual conditions indicated with the products represent the offer of the Seller for the conclusion of the Contract. The subject of the Agreement is the purchase of the selected product through the web store www.baitsinfinity.com. These General Terms and Conditions form an integral part of the sales contract concluded through the web store. When viewing the contents of the BAITSINFINITY web store, you are free to select the desired items and add them to the cart. Once you have selected the desired items and you are sure you want to buy them, you start the order process where you enter all the information needed to place an order, confirm your agreement with the General Terms and Conditions of the web store, and depending on the selected payment method The actions you have performed and confirmed during the order submission process are considered to be the conclusion of the sales contract and as such are binding. The contract enters into force from the moment when the seller accepts the offer of the Seller, in this case when he confirms all the performed actions. The bid confirmation process will take place in such a way that after submitting your order, you will receive an automatically generated confirmation of receipt of the order to the e-mail address you entered in the order process (hereinafter ‘Confirmation’). The confirmation of receipt of the order is not considered a confirmation of the conclusion of the contract of sale by the seller, but is only a document confirming the receipt of the order.
PRICES OF PRODUCTS AND SERVICES THROUGH WEB TRADE
All prices on the website are expressed in kunas (HRK) or euros (EUR). The buyer is charged the price in HRK regardless of the highlighted currency. The Buyer outside the Republic of Croatia who chooses the option of payment by proforma invoice, the price will be expressed in euros (EUR) on the proforma invoice and the Buyer will make the payment in euros (EUR). The prices shown are retail (the final price that the customer pays for the product including VAT) and are valid for all forms of payment. The ordered goods are delivered at the prices and conditions valid on the web store on the day of placing the order, regardless of the prices and conditions valid on the day of delivery. By confirming the purchase, registered users complete the purchase process through the web store. The delivery price of purchased products is not included in the product price. TERMINATION OF THE SALES AGREEMENT
Pursuant to the Consumer Protection Act, the user has the right to unilaterally terminate the Agreement within 14 days without giving a reason. In order to exercise the right to unilaterally terminate the Agreement, the user must notify us of his decision to terminate the Agreement unilaterally by an unequivocal statement sent by mail or e-mail, stating his name, address, telephone, fax or e-mail address. Properly completed copy of the Form for unilateral termination of the contract of sale, together with the original invoice can be delivered in a package together with the goods to the address: B. If the user unilaterally terminates the Contract, we will refund the money we received from the user, excluding delivery costs without delay, and no later than 14 days from the date of receipt of the user’s decision to unilaterally terminate the contract. The cost of replacing the product is borne by the buyer in the same amount in which the goods were delivered, except when it is possible to choose a cheaper option for the cost of returning the product, in which case the buyer may bear the cost of replacing the product. In the event of termination of the contract, each party is obliged to return to the other what it received under the contract. According to Article 72 of the Consumer Protection Act, you are obliged to return the received goods to the address B. Jelačića 54, 32100 Vinkovci, Croatia. The refund will be made in the same way as you made the payment. We can refund only after the goods are returned to us. The user should send the goods or hand them over to us without undue delay, and in any case no later than 14 days from the day he sent us the decision to unilaterally terminate the contract. In the event of the user’s unilateral termination of the contract, the direct costs of returning the goods must be borne by the user. In the event of the user’s unilateral termination of the contract, the user is responsible for any impairment of the goods he returns, which is the result of handling the goods, except that necessary to determine the nature, characteristics and functionality of the goods. We are liable for material defects in accordance with the provisions of the Civil Obligations Act. If an error occurred during the packaging of the ordered products and the user did not receive the ordered product but another, in which case, the user returns the wrong product at the expense of the Seller who undertakes to deliver the ordered product or refund (according to the user’s request) within 14 days from the received incorrectly delivered item. The only precondition for unilateral termination of the Contract is that the goods have not been used and that they are in the original packaging with the original labels.
RIGHTS AND OBLIGATIONS OF THE SELLER
It is the Seller’s duty to deliver the sold item to you on time and in the manner specified in the presented terms of business, after you place the order and pay the purchase price. Pursuant to the Civil Obligations Act of the Republic of Croatia, the Seller is liable for material defects of the goods sold on the web store. The seller must provide true information about the goods offered and provide complete information about the payment of the purchase price and delivery of the goods. If the web store is temporarily unavailable or available only to a limited extent, due to system upgrades, technical difficulties, force majeure or other causes, the Seller is not responsible, regardless of cause and duration, for any unavailability of the web store, any delay or interruption in transmission of information, partial or complete interruption or malfunction and / or technical problems that may lead to incorrect data processing and any claims or losses arising therefrom. In the event of failure of public or private telecommunications networks, the Seller shall not be liable for any inability or delay in the performance of any of its obligations under these Terms or any of the contracts in the event that it is the result of any action or event beyond reasonable control. seller. In such situations, the seller will try to fulfill his obligations as soon as possible. The seller is not obliged to enter into a contract of sale on the basis of the received order in the event that he cannot fully fulfill the obligations under the contract. RIGHTS AND OBLIGATIONS OF THE BUYER
The buyer is obliged to pay the price specified in the contract. He is also obliged to pay the delivery costs if they are included in the total value of the order, and take over the purchased products upon delivery. If the buyer is dissatisfied with the purchased product, he has the right to complain and contact the seller according to the instructions. If the customer does not take over the product or refuses to take over the product without a valid reason, Hostonski d.o.o. reserves the right to claim reimbursement of handling, transportation and other possible costs.The buyer is responsible for any impairment of the goods from the moment of their takeover, which occurs as a result of handling the goods. The user undertakes not to use the website in any way contrary to the positive regulations or to use the website to send e-mails contrary to these General Terms and to enter or distribute through the website any illegal software, including but not limited to viruses, spyware , Trojans, or the like. The buyer has the right to unilaterally terminate the sales contract within 14 days of receipt of the goods
COMPLAINTS AND MANNER OF SETTLEMENT OF DISPUTES
The user can contact us and send a complaint to the e-mail address: info @ baitsinfinity.com, in case he notices an error, problem, violation, unacceptable content and the like published in the web store or on the website of the Seller. We will respond to any decent written complaint within 15 days of receiving it. PAYMENT METHODS
For domestic deliveries (Croatia) you have the following payment options:
– Payment by proforma invoice via bank transfer (with this method of payment, you will receive a proforma invoice with all the necessary information for payment to your e-mail address)
– Payment by cash on delivery (maximum amount of cash on delivery can be HRK 12,500.00). An option that allows you to pay the amount of the order during delivery to the address you specified for delivery.
– Payment via the Internet (cards) – Baitsinfinity web store uses the Stripe system for online payments for payments by credit and debit cards (Mastercard, Visa, Diners, Discover and American, one-time payment) and through the Google Pay and Apple Pay systems. To pay with credit and debit cards, we use the well-known online payment processing platform – Stripe. Stripe is a Level 1 PCI Certified Service Provider. This is the strictest level of certification available in the payments industry. All card numbers are encrypted at rest with AES-256. Hostonski d.o.o. does not assume responsibility for any direct or indirect damages that customers may suffer due to the temporary, partial or complete unavailability of the Stripe service. The customer’s credit card information is not in the database of the Baitsinfinity web store or Hostonski d.o.o., but only and exclusively on the bank’s server. In order to protect your data, the Stripe system does not allow the payment of an amount greater than the transaction amount, nor does it allow access to your card number. Hostonski d.o.o. does not have access to the customer’s bank details and does not have access to the customer’s card number at any time. Only the number of the authorized transaction is available to her, which enables the payment of the entire or partial amount of the agreed transaction or cancellation for reasons agreed with the customer. Payment via the Google Pay system- When you select Google Pay, you will be redirected to the Google Pay payment system. After signing in to Google Pay, you need to confirm the payment of the order. Payment via the Apple Pay system– When you select Apple Pay, you will be redirected to the Apple Pay payment system. After signing in to Apple Pay, you need to confirm the payment of the order.

For deliveries abroad, you have the following payment options:
– Payment by advance invoice via bank transfer
– Payment via the Internet (cards)
The buyer is obliged to request the R1 invoice when fulfilling the order, subsequent requests for the R1 invoice will not be accepted.
If the payment is made by bank transfer (bank transfer or internet banking), the buyer is obliged to use the payment details received by e-mail from the seller.
The agreed purchase price includes all taxes.
DELIVERY
CROATIA
The product will be delivered to the customer in the territory of the Republic of Croatia within 24-48 hours (Saturday, Sunday and non-working days excluded) from the delivery of the product to the delivery service.

Upon request, it is possible to pick up in person at the place of delivery in Vinkovci, at the address B. Jelačića 54, after payment according to the pro forma invoice and by agreement via e-mail / phone.
Hostonski d.o.o. is not familiar with the customs regulations of non-EU countries, so he is not responsible for possible additional costs for the recipient.
The stated price list for sending outside Croatia implies sending one package. Hostonski d.o.o. can change and adjust prices according to the prices of delivery services with the notification of the buyer.
Hostonski d.o.o. has contracted delivery with delivery services GLS and DPD. Delivery is made to the entrance to the residential building of the desired address. In the case of a residential building, the delivery person is not obliged to carry the goods to the floor where the buyer is located, but to the entrance to the building. After the order and at the moment when the package is ready to be sent, the recipient will be notified via SMS and / or e-mail. The first notification contains information that the package in domestic distribution will be delivered the next working day, as well as the delivery address and the possible amount of cash on delivery. The second e-mail or SMS is sent in the morning on the day of delivery, when the courier picks up the package and when he sets a 3-hour time interval for the expected delivery time. This message contains the telephone number of the courier and the contact telephone number of the customer service. As early as 15 minutes after a failed delivery attempt, the recipient receives an electronic notification and can immediately manage the further fate of the package via the Internet. Buyers are obliged to pick up and inspect the shipment in front of the delivery person, all in order to avoid subsequent complaints due to the possibility of damage to the shipment during delivery. If the customer does not take over the product or refuses to take over the product without a valid reason, Hostonski d.o.o. reserves the right to claim reimbursement of handling, transportation and other possible costs.
RETURNS AND COMPLAINTS
The order can also be canceled before it is sent to the delivery address. In case of order cancellation, send us a notification to info@baitsinfinity.com for a refund. In the case of cancellation of the order after payment by advance invoice or payment via the Internet (cards), the paid funds will be returned to the Customer as soon as possible, minus the costs of receiving/refunding the funds.
If you have ordered and received the goods at the address, but still want something else, you can make a replacement within 14 days of receiving the product:
- it is necessary to make a unilateral termination of the Purchase Agreement, with the return of the item
- A new order for the desired product can be made at any time
You return the delivered product to the Seller at your own expense to the Seller’s address by agreement, in the original packaging, complete with all associated parts and documentation, and any mark indicating that the product has not been used or damaged must not be removed or damaged.
UNILATERAL TERMINATION OF THE CONTRACT OF SALE
You can terminate the contract unilaterally within 14 days without giving a reason. It is necessary to fill in the Form for unilateral termination of the contract of sale, concluded at a distance and pack the product in a box, with the said Contract. In order to be able to exercise the right to unilateral termination of this Agreement, you must notify us of your decision to unilaterally terminate the contract before the deadline by an unequivocal statement sent by mail to Hostonski doo, B. The deadline for unilateral termination is 14 days from the day when the goods that are the subject of the contract were handed over to you or to a third person designated by you, who is not a carrier. We will send you an acknowledgment of receipt of the notice of unilateral termination of the contract by e-mail without delay. Upon receipt of the form, we will contact you to arrange a refund details. It is considered that you have fulfilled your obligation on time if you send or hand over the goods to us, ie to the person we are authorized to receive the goods, before the expiration of the above-mentioned deadline. If you unilaterally terminate this Agreement, we will refund the money we received from you, which does not include shipping costs, without delay, and no later than 14 days from the date we received your decision to unilaterally terminate the contract. We can refund only after the goods are returned to us or after you provide us with proof that you have sent the goods back to us.
The condition of termination of the said Agreement is that the purchased goods have not been used. If use (impairment) has occurred, the supplier will, upon receipt of the returned goods in the warehouse, assess the condition of the goods, according to visible signs of use and accordingly determine what percentage of the refund will be paid to the buyer. We refund only upon receipt of the returned goods, in the same way as the payment was made, ie by payment to the account if the payment was made by cash on delivery.
COMPLAINTS
Complaints are made for goods:
- which was submitted incorrectly,
- which is not complete due to some defects arising before or after packaging, but not by the Buyer.
We advise you not to pick up the package before signing the delivery note, but to open it in the presence of the delivery person and check the appearance of the ordered goods, especially if the package shows visible damage. You are responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods. If the goods have visible damage, defects or are goods that you have not ordered, please do not pick up the package so that the delivery service can return such goods to us. If this situation occurs, please contact us at info@baitsinfinity.com or by phone, at 098 / 169-75-94. Also, send us a photo of the said complaint so that it can be accepted on the basis of physical evidence. If it is determined that the delivered item is damaged / defective through no fault of the Buyer, you can arrange a new delivery of the correct goods, replacement of the item or possible refund in case the goods you want are not available. If you have picked up the ordered goods and subsequently identified damage, defects or defects that did not occur as a result of your handling, and before or just after the first use of the product, we must contact us within a maximum of 8 days of receipt of the product. Hostonski d.o.o. reserves the right to reimburse the costs incurred in the process of return which is not justified, ie when the delivered goods are the ones that were ordered and there are no damages, defects or defects.
